Client Portrait Agreement

    Terms and Conditions of Jessica McCoy Photography, hereafter referred to as PHOTOGRAPHER.  
    Jessica McCoy Photography is referred to as JMP from here on
    • Client understands that the retainer is due immediately upon booking to reserve the session date on JMP's calendar. Session is not on the calendar until such time that the retainer is paid in full via paypal.com. Retainers will only be refunded by discretion of photographer. 
    • The remaining amount of session fee is due at the time of the photoshoot.  If client does not pay at this time (ie. you want to paypal me later) photos will not be edited until session fee is paid
    • If client is more than 30 minutes late to session time scheduled by JMP, the client forfeits the retainer, and it becomes nonrefundable and nontransferable at that time.
    • JMP is required to provide client with a minimum of 30 high resolution digital negatives via www.shootproof.com four (4) weeks after session date. Client gallery will be active for 2 weeks.  After this time, reactivation has a fee of $50.
    • JMP may capture many images during your session, but Client will see only those images carefully selected by the photographer in the gallery. Each finished image is carefully edited by the photographer to ensure maximum artistry and technical perfection. Images with eyes closed, heads turned, duplicates, mis-focus etc. will not be shown. No unedited images will be released under any circumstance. Basic and necessary touch-ups will be performed at the discretion of the photographer. You can request up to 2 changes, any requests above this will be billed at $25/image, and must be requested with 3 days of final gallery delivery. This may include things such as extensive blemish or scar removal, head swapping, body slimming, etc
    • JMP is not held responsible for behavior of parties involved with the shoot, with the exception of studio personnel. If the desired outcome of your session is jeopardized by the behaviors of parties involved, including children and babies, JMP cannot be held responsible.
    • JMP retains copyright to any and all photographs, and hereby grants the Client private printing rights only. The client is to not, under any circumstance, provide any images taken by  JMP for monetary gain, marketing, or commercial use.
    • At such time that JMP provides the Client with a digital gallery to download images, JMP’s contractual obligation is fulfilled. Refunds are prohibited and reshoots will be at the discretion of JMP only. Client accepts that images provided will be consistent with photographer’s work as displayed on JMP's website and social media.
    • Do not reedited any pictures. Instagram filters or any other smart phone editing applications are to not, under any circumstance, be placed over an JMP photo.
    • Client reserves the right to refuse the use of any images of their likeness on social media outlets (including, but not limited to Facebook, JMP website,  and Instagram). Client is to make JMP aware of this request on or before the session date. JMP does not post an image from every session on social media. 
    • JMP reserves the right to refuse or cancel service at any time as such a Client/Photographer or potential Client/potential Photographer relationship is deemed irreconcilable.
    • Photographer agrees to continue to carry appropriate and legally required business and liability insurance, as required by the State of California. The client shall assume all responsibility for their own safety and the safety of any other members of their party, including children and pets. The client and any person or animal accompanying the client releases JMP from all claims and liabilities of any kind.
    • Failure to Perform. If the Photographer cannot perform this Agreement due to a fire or other casualty, strike, act of God, or other cause beyond the control of the parties, or due to the Photographer’s illness, then the Photographer shall return the retainer to the Client but shall have no further liability with respect to the Agreement. This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera or computer malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of the Photographer. In the event the Photographer fails to perform for any other reason, the Photographer shall not be liable for any amount in excess of the retainer or session fee.


    This contract shall be governed by the laws of the State of California and any applicable Federal law.

    Please review and sign contract within 24 hours of receipt to secure your date. 

    Lastly, because I really dislike going to the bank and Square (credit cards) takes 4% of my profits, I will be offering $20 off if you bring cash. 

    This is a contract for personal photography services to be provided by the Photographer and/or individuals subcontracted to do work for the Photographer. The parties agree to the above and below terms and conditions, and acknowledge that they have received, read, and understand the Photographer’s current price list.

***Some info about your shoot. All pictures will be delivered via online gallery. My estimated wait time for your fully edited pictures is 4 weeks/1 month.  Sometimes (usually) I will edit 5-10 pictures and send them to you in the first week.  WHY? Because I have been the client.  I know you are DYING to see your pictures, or at least I was.  This is how I do it.  If you don't want a sneak peak, tell me, and I will just give them all to you within that 4 weeks.
